Statutory protection is available for intellectual property rights and industrial property rights. The following provides an overview of the major forms of IP protection available under Indian law.
Intellectual Property (IP) refers to intangible assets created through human knowledge, innovation, and creativity. Intellectual Property Rights (IPRs) are the legal rights granted to owners of such assets under various laws.
Major forms of IP include patents for inventions, trademarks for distinctive signs and symbols, industrial designs for product appearance, copyrights for original literary, artistic, musical, and software works, performers' rights, circuit layout rights for integrated circuits, plant breeders' rights for new plant varieties, and protection of trade secrets and confidential information.
As an intangible asset, intellectual property can be transferred like other forms of property through assignment, gift, exchange, inheritance, company acquisition, or bankruptcy proceedings, and such transfers may be subject to applicable stamp duty and taxes.
A patent is an exclusive legal right granted to an inventor in exchange for disclosing the invention and its method of operation. An invention may be a product or process that introduces a new way of performing a task or provides a novel technical solution to a problem.
The patent owner has the exclusive authority to prevent others, except those authorized by them, from making, using, selling, or otherwise exploiting the patented invention. To qualify for patent protection, an invention must be novel, involve an inventive step, be useful or capable of industrial application, and must not be obvious to a person skilled in the relevant field.
Discoveries of natural phenomena, frivolous inventions, scientific theories, mathematical methods, plant or animal varieties, natural substances, commercial methods, and methods of medical treatment are generally not patentable. In India, once granted, patents remain valid for 20 years from the filing date, subject to annual renewal.
To obtain protection in multiple countries, separate applications must generally be filed, although regional systems such as the European Patent Office (EPO) and international mechanisms like the Patent Cooperation Treaty (PCT) simplify the process. The PCT facilitates international applications through services such as international searches and preliminary examinations.
Under compulsory licensing provisions, the government may authorize others to manufacture and sell a patented product if the patent is not worked on reasonable commercial terms, is unavailable at affordable prices, or in cases of national emergencies or public health crises — with the patentee receiving appropriate royalty payments.
A trademark is a type of intellectual property which can consist of a word, letters or numerals, device, symbol, shape of goods, colour, phrase, sound or a combination thereof. It is a sign identifying and distinguishing the goods and services of one enterprise from another. The goods and services are classified under various categories as per the NICE classification.
The first step while seeking registration of a trademark is a search of the online trademark register, internet, and a market survey to ascertain the availability and potential conflicts prior to filing an application. Once complete, the report is analysed by the Advocate highlighting the potential conflicts, comparison and advice on whether the proposed trademark is recommended or not recommended for registration.
Though the trademark search exercise appears exhaustive, it is highly recommended and one must not skip this prior to making an application for a trademark.
A design refers to the visual features of a product, including its shape, configuration, pattern, ornamentation, or composition of lines and colours applied to an article in either two-dimensional or three-dimensional form. Under the Designs Act, 2000, design protection is granted only to the aesthetic appearance of a product and does not extend to its functional, mechanical, or technical aspects.
To qualify for registration, a design must be new, original, and not previously disclosed to the public. Examples of registrable designs include the appearance of consumer products, packaging, furniture, electronic devices, fashion accessories, and industrial products.
A registered design grants the owner exclusive rights to use, license, and prevent unauthorized copying of the design. In India, design protection is valid for 10 years from the date of registration and can be renewed for an additional 5 years. Applications are filed electronically with the Indian Patent Office and early filing is crucial as public disclosure before filing may destroy the novelty of the design.
Design registration is particularly valuable in industries such as consumer goods, fashion, electronics, automotive, packaging, and industrial manufacturing.
Copyright is a statutory right under the Copyright Act, 1957 that protects original literary, artistic, musical, dramatic works, films, and sound recordings the moment they are created — no registration is required; it is an inherent right.
It gives the owner exclusive rights to reproduce, publish, adapt, translate, and communicate the work to the public. Protection generally lasts for the author's lifetime plus 60 years.
Infringement occurs when these rights are exercised without licence or authorisation. Remedies include civil suits for injunction and damages as well as criminal prosecution.
In India, Geographical Indications of goods are a type of intellectual property governed under the Geographical Indications of Goods (Registration and Protection) Act, 1999. The term 'geographical indication' in relation to goods means an indication which identifies such goods as agricultural goods, natural goods or manufactured goods originating in a territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of such goods is essentially attributable to its geographical origin.
In simple terms, a geographical indication is a special tag given to any agricultural, natural, handicraft, or manufactured goods that come from a particular place and have a unique quality, specialty, feature, or reputation linked to that place.
Registration shall be for a period of ten years but may be renewed from time to time. Well-known examples include Darjeeling Tea (West Bengal), Chanderi Sarees (Madhya Pradesh), Mysore Agarbathi (Karnataka), Bikaneri Bhujia (Rajasthan), and Waigaon Turmeric (Maharashtra).
The Semiconductor Integrated Circuits Layout-Design Act (SICLD), 2000 is an Indian legislation that provides legal protection to the layout designs (topographies) of semiconductor integrated circuits.
Enacted to promote innovation and protect intellectual property in the semiconductor industry, the Act grants exclusive rights to creators and registered proprietors of original layout designs. It prevents unauthorized reproduction, imitation, or commercial exploitation of registered designs and encourages technological development and investment in the electronics sector.
The Act also aligns India's intellectual property framework with international standards for semiconductor design protection.
